President Donald Trump, on July 4th, 2025, signed the "Big Beautiful Bill" into law, which included a provision for zero tax on suppressors, short-barreled rifles and short-barreled shotguns.
The effective date of the Zero Tax on Suppressors, SBR's and SBS's will be January 1, 2026.

Gun Owners of America (GOA) just announced plans for what it’s calling the “One Big Beautiful Lawsuit” to tear down the NFA’s remaining registration mandates. This comes as President Trump has signed the “One Big Beautiful Bill” into law, zeroing out the $200 tax on suppressors, SBRs, SBSs, and AOWs.
GOA said it fought behind the scenes to fully repeal the NFA but Congress punted. Republicans let an unelected bureaucrat block the total repeal, so the tax was slashed to $0 instead.
Here’s why that matters:
The 1937 Supreme Court decision Sonzinsky v. United States upheld the NFA solely as a tax statute, not as a gun control law. With the tax gone, GOA argues the entire constitutional justification crumbles.
“This is a once-in-a-generation opportunity to dismantle one of the most abusive federal gun control laws on the books,” said Erich Pratt, GOA’s Senior VP. “With the tax struck down by Congress, the rest of the NFA is standing on air. We’re ready to end the federal registry once and for all.”
Aidan Johnston, GOA’s Director of Federal Affairs, didn’t hold back either: “Congress should never have shifted responsibility to the courts to strike down the archaic National Firearms Act of 1934. Now GOA will do what Republicans would not.”
The Second Amendment Foundation (SAF) is also gearing up its own lawsuit, alongside the American Suppressor Association, NRA, and Firearms Policy Coalition.
SAF Executive Director Adam Kraut said, “With the One Big, Beautiful Bill zeroing out the tax… the registration scheme serves no other purpose than to create an unlawful barrier to keep people from exercising their Second Amendment rights.”
Palmetto State Armory, Silencer Shop, and B&T USA all issued statements backing GOA’s legal push.
Travis White of the Firearms Regulatory Accountability Coalition summed up the industry mood: “Congress reducing the tax to $0 leaves no further doubt as to the indefensible character of that Act.”
The lawsuits will argue that with no tax, the NFA’s registration mandates are unconstitutional and should be struck down entirely, removing what GOA calls a nearly century-old “obsolete and abusive law.”

Senate Parliamentarian Nixes Repeal of NFA Taxes and Registration in Budget Bill
It was great while it lasted.
The idea of short-barreled rifles and shotguns, as well as suppressors being lawful for sale at your local gun store, was something I was severely looking forward to.
Gun Owners of America helped craft both measures so they could pass the so-called Byrd Rule. After all, the NFA is a tax. They've said it was a tax for decades, which is why defenders claimed it didn't violate the Second Amendment. Both measures were created to address it as such.
And yet, now, it looks like our hopes and dreams are dead.
Maybe.
The Senate’s top rule-maker has determined the effort to delist silencers, short-barrel rifles and shotguns, and other guns from the National Firearms Act (NFA) of 1934 doesn’t fit within budget reconciliation rules.
Just after midnight on Friday, Senate Budget Committee ranking member Senator Jeff Merkley (D.) announced the NFA provision did not comply with the Byrd Rule. He said it was part of another five provisions of the Republican budget bill the parliamentarian ruled are beyond the scope of what’s allowed in the reconciliation process. That means the provision would need 60 votes to pass.
“We have been successful in removing parts of this bill that hurt families and workers, but the process is not over, and Democrats are continuing to make the case against every provision in this Big, Beautiful Betrayal of a bill that violates Senate rules,” Merkley wrote in a press release.
The decision means the Senate’s version of the NFA proposal is likely dead. It’s a setback for gun-rights activists who’d taken a risk by pressuring Republicans to push for full delisting after the House Ways and Means Committee initially proposed just eliminating the $200 tax on the devices.
However, Republicans could rerun the proposal through the Parliamentarian process in its original form, as they’ve successfully done with several other provisions that she initially stripped out.
That’s something gun-rights activists have planned as a fallback if full delisting, which would not just eliminate the tax but also the registration requirements on the devices, was tossed out under the Byrd Rule.
Senator Merkley said he also expects Republicans to rewrite and rerun several parts of the budget bill that have been removed.
It seems some staffers are blaming gun rights groups for overpromising and arguing that now, Republican lawmakers will be taking the heat for not delivering something that could never be delivered.
Frankly, I think those staffers need to stuff it.
I'm sorry, but that's just how I see it, and I'm not backing down on that one, either.
Now, it's possible that things will pan out with what is termed as the fallback. It's also possible that Vice President JD Vance overrides the parliamentarian, who actually doesn't have any real authority per the Constitution, as I understand it. However, the latter isn't likely, in my opinion, not because Vance would be unwilling necessarily, but because that's kind of a nuclear option that once uncorked, will start being abused by future administrations, including very gun-hostile ones.
Let's just say that right now, I'm less than thrilled with things. I'd love to see a pivot and us get the wins we've been hoping for, but I can't be optimistic.
Instead, let me just say that we need to remember this in the midterms. Every anti-gunner in the Senate up for re-election needs to be removed so that this is a non-issue going forward. We need to hit the House with the same approach. Then we can let this go through directly, with a supermajority in both chambers, and make things happen for gun rights like they've never happened before.
June 18, 2025 - UPDATE:
The Hearing Protection Act has been included in the "Big Beautiful Bill" - or H.R.1 which has passed out of the U. S. House of Representatives and sent on the U. S. Senate.
The Senate is currently working/reviewing this Bill. In so doing, changes are being made. Keep in mind that this Bill encompasses much more than just Silencers/Suppressors - Tax Law; Border Funding; Etc.
The Senate is anticipating to complete action on this Bill prior to July 4th but certainly may extend beyond that date.
Since changes have been made, the Bill will have to be sent back to the House for approval of any Amendments.
The Gun Owners of America (GOA) announced that the Senate Finance Committee has modified the One Big Beautiful Bill to fully repeal the excise taxes imposed by the National Firearms Act (NFA) on several categories of firearms and accessories. These include suppressors, short-barreled rifles and short-barreled shotguns. This development is, on its face, a significant step forward for gun owners and supporters of Second Amendment rights when it comes to de-fanging the NFA.
If I understand everything correctly, this version of the bill effectively removes SBR's, SBS's and suppressors from the NFA’s registration requirements by redefining "firearm" under 26 U.S.C. § 5845(a) to exclude them, rendering 26 U.S. Code § 5841 - Registration of firearms inapplicable. They will shift to Gun Control Act Regulation, which will likely require only a Form 4473 process - just like any firearm.
Also, as I understand it, the effective date of this Bill, and its provisions, will be the beginning of the calendar quarter at least 90 days after the President signs the Bill. For example, if the President signs this Bill in July, then the 90-day period would be to sometime in October, and the next calendar quarter would begin on January 1, 2026. This January 2026 effective date would apply if the Bill is signed anytime by the end of September.
For anyone not wanting to wait, we can process a suppressor purchase under the current NFA requirements, including the payment of the $200 Tax Stamp. Time from beginning the paperwork to approval is currently about 30-45 days.

This will also eliminate the $200 Tax Stamp requirement and subsequent wait times, fingerprints and photos.
Passage of this Bill will undoubtedly assure a surge in silencer or suppressor sales and a subsequent shortage in the industry, which may also cause an increase in pricing industry wide.
Current backorder wait-times for silencers or suppressors range as much as 60 days or more, and these times are anticipated to increase.
